Please read these Terms & Conditions ("Terms") carefully before using the services or website of Asphalt Wizards, Inc. ("Asphalt Wizards," "we," "us," or "our"). By requesting a quote, engaging our services, or using our website at asphaltpavingwizards.com, you agree to be bound by these Terms.

1. Services

Asphalt Wizards provides residential and commercial asphalt paving, seal coating, crack sealing, line striping, concrete services, and related work in Independence, MO, Lawrence County, Warrensburg, and surrounding areas.

All services are subject to a written estimate or contract accepted by both parties. Verbal representations do not constitute a binding agreement unless confirmed in writing.

2. Estimates & Quotes

• Free estimates are provided without obligation and are valid for 30 days from the date issued unless otherwise noted.
• Final pricing is based on actual site conditions observed at the time of work. Estimates may be revised if conditions differ materially from those assessed during the initial visit.
• Changes to project scope requested after work has begun may result in additional charges.

3. Payment Terms

• Payment terms are specified in the written estimate or contract. In the absence of other terms, payment is due upon project completion.
• For larger projects, a deposit may be required before work begins. Deposit amounts will be stated in the contract.
• Unpaid balances may be subject to a late fee of 1.5% per month or the maximum allowed by Missouri law, whichever is less.
• We accept cash, check, and major credit cards unless otherwise stated.

4. Scheduling & Weather

Asphalt and seal coat work requires appropriate weather conditions. We reserve the right to reschedule jobs due to rain, extreme temperatures, or other conditions that would compromise the quality of work. We will notify you of any rescheduling as promptly as possible. Delays due to weather do not constitute a breach of contract.

5. Customer Responsibilities

• You are responsible for obtaining any required permits unless otherwise agreed in writing.
• Clear the work area of vehicles, equipment, debris, and personal property before the scheduled start date.
• Provide reasonable access to the work site, including utilities needed for the job.
• Notify us of any underground utilities, irrigation lines, or other buried infrastructure prior to work beginning. We are not liable for damage to undisclosed underground features.

6. Warranty

Asphalt Wizards stands behind our work. We offer a 1-year workmanship warranty on asphalt paving and installation services, covering defects in materials or workmanship under normal use and conditions.

This warranty does not cover:

• Damage caused by excessive vehicle loads beyond the design specifications of the pavement
• Damage from tree roots, soil movement, or pre-existing sub-base conditions not disclosed prior to work
• Normal surface cracking due to temperature cycling (hairline cracks are a natural characteristic of asphalt)
• Damage resulting from chemicals, fuel spills, or improper use
• Seal coating, line striping, or crack sealing (these are maintenance services with no structural warranty)

Warranty claims must be submitted in writing within the warranty period. Our sole obligation under this warranty is to repair or re-perform the defective work at our discretion.

7. Limitation of Liability

To the fullest extent permitted by law, Asphalt Wizards' total liability to you for any claim arising out of or related to our services or these Terms shall not exceed the amount paid by you for the specific services giving rise to the claim. We are not liable for any indirect, incidental, consequential, or punitive damages.

8. Cancellation

Either party may cancel a scheduled job with at least 48 hours' notice without penalty. Cancellations made less than 48 hours before a scheduled start may result in a cancellation fee to cover mobilization costs, as specified in the contract. If materials have already been ordered or fabricated for your project, you may be responsible for those material costs.

9. Governing Law

These Terms are governed by the laws of the State of Missouri. Any disputes arising from these Terms or our services shall be resolved in the courts of Jackson County, Missouri, and you consent to personal jurisdiction in such courts.

10. Website Use

The content on asphaltpavingwizards.com — including text, images, and logos — is owned by Asphalt Wizards, Inc. and may not be reproduced without written permission. We make no warranties that the website will be error-free or uninterrupted, and we reserve the right to modify or discontinue any part of the site at any time.

11. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of our services or website after changes are posted constitutes acceptance of the updated Terms.
